    Petition

Amend the Land Use Act of 1978

The Land Use Act vested all land in state governors and severed Ijaw communities from the legal ownership of their ancestral territory. The Council's petition, built on the draft amendment published in The Enclosure of the Water World, demands six structural corrections:

    1. 1

Convert land over oil-bearing and gas-bearing formations into registered communal title held by the host community, as provided in the draft amendment.

    2. 2

Require free, prior and informed consent of host communities before any allocation, licence or acquisition affecting communal land.

    3. 3

Restore the 50% derivation principle agreed in the pre-independence fiscal commissions, phased from the current 13%.

    4. 4

Raise the PIA Host Communities Development Trust from 3% to a figure reflecting actual remediation costs, with community-controlled trustees.

    5. 5

Mandate automatic five-year legislative review of the Land Use Act and Petroleum Industry Act environmental provisions.

    6. 6

Fund full implementation of the UNEP Ogoniland recommendations as the template for remediation across Ijaw territory.

    How the Council works

    Evidence first

Every briefing is anchored on documented law and precedent — the Land Use Act, the PIA, UNEP Ogoniland, and decided cases in the evidence library.

    Diaspora delegations

Ijaw professionals in Washington, London and Brussels join scheduled delegations; the Council provides briefing packs and talking points.

    On the record

All correspondence is copied to Nigeria's missions and logged, so engagement is formal, traceable and cumulative rather than episodic.
